Divorce is an emotional experience that alters your life. You have several options that will, to a great degree, dictate the path of your divorce. These options include litigation and alternative dispute resolution, including the collaborative model, mediation or conciliation.

Collaborative law is a method whereby the parties and their attorneys agree to resolve the conflict using cooperative strategies rather than adversarial techniques and litigation. They agree in advance not to go to court except for obtaining the divorce judgment in an uncontested proceeding. Negotiations are conducted primarily in private meetings with clients and attorneys in the room. Full disclosure, equity, creativity, peacefulness and privacy are the hallmarks of this process.

Mediation is the process in which divorcing couples jointly hire a mediator to guide them through the divorce process as they negotiate the terms of their own divorce. The couples then may or may not meet with their own personal attorneys who will coach them and provide them with information and answer questions before and after mediation sessions. The mediation sessions typically occur without the attorneys being present.

Conciliation is the process where a divorcing couple and their attorneys agree to jointly hire a conciliator to actively assist with the resolution of the issues in dispute offering constructive input and assessments as to the strengths and weaknesses of each party’s case and or position. The meetings occur with each party and their respective attorney being present.

When a divorce cannot be resolved through the collaborative, mediated or conciliation models, then the traditional litigation model is the only option. The litigation model is most often used in high-conflict family law matters, where domestic abuse has occurred, where one party refuses to provide full disclosure of financial matters, or where there are important goals that cannot be negotiated and require judicial intervention.
